ADDITIONAL TERMS AND CONDITIONS
FOR MOBILE SECURITY AND PERSONAL EMERGENCY RESPONSE SYSTEMS
USING CELLULAR AND GEO LOCATION SERVICES
By executing this Agreement either in writing or by clicking "I agree" on the Company's website, you, the Subscriber, have acknowledged having read, fully understood and accepted these additional terms and conditions of the Company's offer to provide a System with cellular and/or GEO location services and to provide monitoring service thereto. You, the Subscriber, agree to be bound by all such terms and conditions and acknowledge that such services will not commence until and unless a test signal from the System has been successfully received at the central monitoring station. The Company fees will begin the date the System is received by you, the Subscriber. The Company is expressly unwilling to provide such monitoring service to you, the Subscriber, if such consent is withheld. By activating the System and sending a signal to the central monitoring station, you, the Subscriber, re-confirm having read this Agreement and accepting all of the terms and conditions contained herein.
Only the party that has accepted all of the terms and conditions may utilize the System and monitoring service of the Company, unless such that party provides the Company with a Power-of- Attorney for the Subscriber.
1. SERVICES. During the term of this Agreement, the Company, or its subcontractor, will provide monitoring service which will include receipt, analysis and response to alarm signals and calls made by Subscriber through the System via cellular transmission. The Company may track the System and, therefore, if you, the Subscriber, provide the System to another person, you become separated from the System, or you do not keep the System battery charged, then the central monitoring station will not be able to track your location or the System may be unable to send signals.
2. GPS, CELLULAR AND/OR WIRELESS INTERNET COVERAGE; GEOGRAPHIC LIMITATIONS. The ability of the System to accurately track your location and receive signals is dependent upon the availability of GPS, cellular network and/or wireless internet coverage, depending upon your location. The System will function only in areas, locations and buildings where such coverage is available. If such coverage is unavailable or unreliable, the System may not accurately reflect the location of you, the Subscriber. In such event, the central monitoring station may be unable to receive a signal and/or communicate the location of you, the Subscriber, to anyone. The System does not track locations outside of the forty-eight contiguous United States; therefore, if you reside outside of such geographic area or you intend to use the System outside of such geographic area, we strongly recommend that you, the Subscriber, do not subscribe to the monitoring service.
3. SUBSCRIBER'S DUTIES: You, the Subscriber, shall test the System in accordance with the instructions provided, including the sending of an initial test signal to the central monitoring center, using the System and the monitoring service in accordance with these terms and conditions, keeping the System charged, and shall not use the System and the monitoring service for any other purposes, not alter, modify or attempt repairs on the System, not allow any other person to use the System unless such person is approved by the Company and the central monitoring center is provided such person's emergency contact information. You, the Subscriber, shall also allow the Company, its central monitoring center and/or its authorized service representative access to the System in order to inspect the System, perform maintenance or repairs to the System, or remove the System after termination or expiration of this Agreement.
4. EQUIPMENT MAINTENANCE. The Company, at its sole discretion, and at your expense may repair or replace the System if it becomes damaged or defective, unless the System has previously been disassembled, repaired or modified by someone other than the Company or its authorized service representative, the System has been damaged as a result of the negligence or misconduct by any person other than the Company or its authorized service representative. If the System becomes damaged as a result of the actions stated herein, you, the Subscriber, shall pay the Company $69.95 for the replacement of the System.
5. RESPONSE. You acknowledge that the central monitoring center shall not be obligated to perform the monitoring service during any time when the System is inoperative.
6. SUSPENSION OR CANCELLATION OF THIS AGREEMENT. You, the Subscriber, understand that the Company may stop or suspend the monitoring service for any of the following reasons: (a) strikes, severe weather, earthquakes or other such events beyond Company's control affecting the operation of the central monitoring station; (b) an interruption or unavailability of the monitoring service as a result of a disruption to the electrical lines, cellular network, radio towers and/or GPS network that prevents a connection between the System and the central monitoring station; (c) the failure of you, the Subscriber, to pay the service charge due to Customer; (d) Company is unable to provide service because of some action or ruling by any governmental authority; or (e) you, the Subscriber, become a debtor in a bankruptcy proceeding.
7. CHANGES TO THE DEVICE. If you, the Subscriber, or any governmental agency or insurance interest requires the Company to change the System described herein, you, the Subscriber, agree to pay the Company all parts and labor charges for such changes. YOU, THE SUBSCRIBER, UNDERSTAND AND AGREE THAT THE SYSTEM CHOSEN BY YOU, THE SUBSCRIBER, DOES NOT PROVIDE INTRUSION OR FIRE PROTECTION.
8. ENTIRE AGREEMENT. This Agreement, together with the MEDICAL ALARM MONITORING SERVICE AGREEMENT, which must be accepted to complete the activation process, constitutes the entire agreement and understanding between the
Company and you, Subscriber concerning the subject matter hereof and supersedes all prior discussions, agreements and representations, whether oral or written and whether or not executed.
I, THE SUBSCRIBER, UNDERSTAND AND AGREE THAT THE COMPANY'S DUTIES AND OBLIGATIONS TO PROVIDE THE SYSTEM, THE MONITORING SERVICE AND ANY OTHER SERVICES ARISE SOLELY AND EXCLUSIVELY OUT OF THIS AGREEMENT, AND THE MONITORING CONTRACT, AND NOT OTHERWISE.
Teltik Communications Wireless, Inc. Privacy Policy

Teltik Communications Inc. ("Teltik Communications") has instituted a comprehensive set of privacy policies and procedures to ensure that its customers and website visitors' privacy is never compromised. The purpose of this privacy notice is to inform our customers and website visitors of the type of information that Teltik Communications, or a credit card processing partner or other vendor acting on our behalf, collects, how the information is gathered, how it is utilized, how long it is retained and how customers and visitors can restrict its use or disclosure.
The primary focus of Teltik Communications' privacy policy is to ensure that all customers and website visitors' personal information, which we term "customer identifiable information," is kept private at all times. As the term suggests, "customer identifiable information" is information which can be associated with a specific individual or entity, including, for example, a customer's name, date of birth, address, telephone number, e-mail address and sensitive information such as credit card information.
The collection of customer identifiable information is a critical element in Teltik Communications' day-to-day operations in order to conduct business and offer services and to maintain the highest level of customer service for all customers and website visitors.
Teltik Communications endeavors to safeguard the customer identifiable information obtained from its website users and visitors (collectively, "customers") from any unauthorized intrusions.
General
We collect personal and non-personal information from customers based upon our business relationship and the nature of the products and services we provide. The types of information we may collect include account information (such as your name, address, home or alternate telephone number), certain financial information relating to any products and/or services that you purchase directly from us (including credit card information, security code and billing address), telephone numbers you call and that have called you and your service history, amongst other information. We also collect and maintain technical information about the equipment you use with our service including serial numbers, SIM card numbers, etc.
In some instances, Teltik Communications may collect information that is not "customer identifiable information." Some examples of this type of information include the type of Internet browser you are using, the type of operating system you have configured on your computer, and the domain name of the website and/or Internet Service Provider from which you are linked to our website. Teltik Communications primarily uses this information for market research and optimizing its systems in order to deliver the best customer experience possible.
Teltik Communications may collect and use customer identifiable information for various purposes, including but not limited to, billing purposes such as the auto-refill program, to provide or change service, to anticipate and resolve problems with your service, or to inform you of products and services that better meet your needs. This means that Teltik Communications may use your customer identifiable information in conjunction with information available from other sources, to market new services that may be of interest to you. When Teltik Communications uses third parties to perform services on its behalf, such as marketing, fulfillment services and shipping to customers, Teltik Communications will request that such third parties protect your customer identifiable information consistently with this privacy policy. Teltik Communications will not, however, disclose your customer identifiable information to third parties who want to market products to you without your express, written or equivalent electronic consent. Teltik Communications will not sell, trade, or disclose to third parties any customer identifiable information derived from the registration for, or use of, a Teltik Communications product or service -- including customer names and addresses -- without the consent of the customer.
Teltik Communications may, however, use and/or disclose customer identifiable information to a third party:
• to investigate and help prevent potential fraud, other unlawful activity or activity that threatens the network;
• as required by law, such as to comply with a subpoena, or similar legal process;
• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
• to any other third party with your prior consent to do so;
• if Teltik Communications is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via a prominent notice on our Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
We will retain your information only as long as needed for business, tax and/or legal purposes. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We will destroy your information once it is no longer needed.
Declining e-mail offers
Teltik Communications will only send our customers e-mails regarding promotional offers or other news if a customer grants us permission to do so and provides an email address. A customer has the right to choose not to receive Teltik Communications e-mail direct marketing communications by opting-out or unsubscribing. A customer can opt-out or unsubscribe from our e-mail list by clicking on the unsubscribe link found at the bottom of every message or promotion delivered electronically to our customers. Upon such election, Teltik Communications (a) will not contact that customer directly with Teltik Communications promotional messages, and (b) will not use customer identifiable information obtained from that customer's registration to contact that customer with Teltik Communications product or service messages.
Security
Teltik Communications has gone to great lengths to implement technology and security features to safeguard the privacy of your customer identifiable information from unauthorized access or improper use. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). Teltik Communications, based on its judgment, will continue to enhance its security procedures as new technology becomes readily available. However, since there is no such thing as "perfect Internet security," Teltik Communications cannot guarantee 100% security. E-mail and Text Message Content
Teltik Communications does not have access to private e-mail communications and text messages that are transmitted using Teltik Communications services.

These websites may collect personal information from website visitors that may or may not be used in conjunction with our website information. Advertisements may appear on pages throughout our website. Some advertisements may request information directly from our customers or take our customers to websites that may request personal information. Third Party Advertising Companies
We collect information about your activity on Teltik Communications websites for a number of purposes using technologies such as cookies, web beacons, widgets and server log files. We and our authorized Teltik Communications advertising partners use that information, as well as other information they have or we may have, to help tailor the ads you see on our sites and to help make decisions about ads you see on other sites. Refer A Friend
If you choose to use our referral service to tell a friend about our site, we will ask you for your friend's name and email address and automatically generate a one-time email to send your friend inviting him or her to visit the site. Teltik Communications does not store your friend's information.
Social Media Features
Our website includes Social Media Features and Widgets, such as the "Share This" button or other interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Occasionally, we may conduct surveys on our website. Surveys are conducted at random and are completely voluntary to our website visitors. Teltik Communications reserves the right to change its privacy policy by publishing new terms on its website at any time. If we make any material changes we will notify you by means of a notice on our website. Children
Teltik Communications websites are not structured to attract children under the age of 13. Teltik Communications believes there is no information on its website which is inappropriate or objectionable for viewing by children. Teltik Communications does not knowingly, directly or passively collect information from children under the age of 13. Ordering online products and services from Teltik Communications is limited to adults (ages 18+). Of course, wireless devices and services purchased for family use may be used by minors without the knowledge of Teltik Communications. If that happens, any information collected from the usage will appear to be the personal information of the actual adult subscriber and treated as such under this Policy.
